LiveAquaria® Rewards Program ("Program") is a rewards program offered by LiveAquaria (LA) for LiveAquaria customers. For purposes of these rules and regulations (hereinafter "program rules" or "rules"), "you," "your," and "Member" mean you as a Member of the Program, the term "Account" refers to your Program membership account, and the term "Reward" refers to the rewards you earn in the Program. LA reserves the right to amend, suspend, terminate, or change, with 30 days notice, the rules of the Program, including but not limited to changing the Reward levels, changing the terms for use of Rewards at any time, and modifying or terminating the Program. Members do not acquire property rights in accrued Rewards. By enrolling in the Program, you agree to abide by these rules and regulations.
- Membership in the Program will be granted by LA through creating of a LiveAquaria customer account and acceptance of these Program rules.
- Membership in the Program is for individuals only. Individuals must enroll separately and may not pool or combine Reward with other Members. Corporations, LA Business Partner Program participants, and other entities may not be enrolled as Members.
- Members are limited to one Program account. A Member must provide all information necessary to open a LiveAquaria account, including his or her legal name, billing address, phone number, and e-mail address. Account specific information will be sent via e-mail to the primary e-mail address in the Member's LiveAquaria account. Members are responsible for notifying LA immediately of any change of email or physical address.
- Upon enrollment, Members' accounts are active for 12 months. Members' accounts will remain active as long as the Member earns points at least once every 12 months. The Member's account expiration date will be extended 12 months from the date of the last earned Reward. If a Member fails to earn a Reward in 12 months, the Member's account will become inactive and all Rewards will be forfeited.
- LA reserves the right to cancel the membership of any Member with no Rewards in the Member's account or a Member who has earned no Rewards for at least 12 consecutive months.
- Members may update e-mail and physical addresses by visiting their account at LiveAquaria.
- Members must be 18 years of age or older at the time of enrollment in the Program.
Earning Program Rewards
- 5% Rewards exclude the following brands: EcoTech Marine, AquaIllumination, Red Sea Aquariums, Neptune, CoralVue, Reef Octopus, Maxspect, Pro Clear, and IceCap.
- Products with manufacturer-set pricing are not eligible for Rewards.
- Members earn Rewards equal to 5% (five percent) of qualifying purchases of any product* at LiveAquaria. For example, a purchase of $100.00 in qualifying goods, excluding shipping, handling and tax, would earn a member 5 Rewards.
- Each Program Reward may be redeemed for $1.00 usable towards future purchases of products, shipping, handling or tax at LiveAquaria.
- Only purchases of products, excluding Gift Certificates, from LiveAquaria are part of this program and earn Rewards. No other purchases from any other Live Aquaria Holdings Corp.,
retail store, partner or otherwise will earn Rewards under the Program.
- Rewards can only be earned by the person whose name appears in the Program account.
- Rewards may not be transferred from one Member's account to another, or to a Member's estate, or as part of a settlement.
- Rewards earned in the months January through February of any year will expire April 30 of the same year. Rewards earned in the months March through April of any year will expire June 30 of the same year. Rewards earned in the months May through June of any year will expire August 31 of the same year. Rewards earned in the months July through August of any year will expire October 31 of the same year. Rewards earned in the months of September through October of any year will expire December 31 of the same year. Rewards earned in the months of November through December of any year will expire the following February 28. Members agree to receive email alerts regarding the Program and status of their Rewards.
- To earn Rewards for each LiveAquaria purchase, Members must complete their purchase using their Member account information.
- Rewards are earned when deposited into the Member's account which generally will occur within 30 days after a purchase has been made.
- If a Reward is credited to a Member for the purchase of a product which is later returned, the Reward associated with that product will be cancelled and deleted from the Member's Rewards account.
- Reships and Credits on File will be excluded from earning Rewards.
Redeeming Program Rewards for LiveAquaria Purchases
- Program Rewards can be redeemed for the purchase of any product, excluding Gift Certificates, at LiveAquaria, as well as shipping, handling and taxes associated with any purchase.
- Members can use their Rewards to pay for all or part of an order. Members will be offered the option at check-out to apply Rewards towards a purchase. Rewards must be used in full when applied.
- The portion of any purchase which is paid for using Rewards is not eligible for granting additional Rewards. Where a Member pays for an order with both Rewards and currency, the Member will accumulate additional Rewards only on the portion of the purchase made with currency.
Additional Program Rules and Regulations
- In addition to Program Rewards, LA may from time to time offer "bonus" or promotional Rewards, partnership programs, or promotional incentives for Members. Such offers are not a part of the Program's formal Reward structure and may be temporary. LA reserves the right to modify or eliminate such offers at any time. These offers are void where prohibited by law.
- Rewards may not be sold, purchased, brokered, or bartered. Rewards have no cash value and are void if sold, purchased, brokered, or bartered.
- All transactions in the Program are subject to review and adjustment by LiveAquaria. LA may cancel the Member's account, Promotional Rewards, or any purchase if misuse or violation of Program rules is suspected.
- Members may earn Rewards equal to 10% (ten percent) of qualifying Auto Delivery items at LiveAquaria. Rewards may not be applied towards future Auto Delivery shipments. If you have any questions regarding the Auto Delivery program, visit the Auto Delivery Program information page here.
